950eff7b-7fa4-4a6a-839f-b0b213e5e2c2-e1564320305784Akinwumi Adesina, president of the African Development Bank (AfDB), is accused of major conflicts of interest by a”Group of Concerned Staff Members of the AfDB” which claims that Mr Adesina has used the bank’s resources for self-promotion and personal gain while also paying out huge but undeserved severance packages to staff who resigned mysteriously, and favouring his fellow Nigerians.

US Treasury Secretary Steve Mnuchin personally signed a letter to the board rejecting an internal investigation that cleared Mr Adesina.
Mr Mnuchin and his advisors are doubling down.

“Undertaking an independent evaluation of facts is not at odds with a presumption of innocence, and by promoting transparency and good governance, it can only strengthen the AfDB’s capacity to deliver results to people across Africa,”
Mr Adesina’s carefully curated career could crumble if a new investigation criticises his reign at the AfDB. His style is solid, but the substance is now under scrutiny.

Associate Chief Justice Heather Holmes ruled that extradition proceedings against the Huawei executive should proceed.

In a widely anticipated decision on so-called double criminality,
Huawei’s legal team argued in January that since the sanctions against Iran did not exist in Canada at the time of her arrest, Meng’s actions were not a crime in Canada. Prosecutors representing the Canadian government countered that the lie itself was the fraud, regardless of the existence of sanctions. A ruling in favour of Meng gives the Canadian government time to decide whether to appeal the decision.

As the judge ruled in favour of the Canadian government, the case will proceed to the next phase in June, arguing whether Canadian officials followed the law while arresting Meng. Closing arguments are expected in the last week of September and first week of October.
Sabrina Meng Wanzhou, 48, was arrested in Vancouver in December 2018. China arrested two Canadians, Michael Spavor and Michael Kovrig, in apparent reprisal for her arrest; they have been in prison for 535 days. Ms. Meng is on bail and living under a form of house arrest in a Vancouver mansion.

[November 22 2019   Huawei Technologies Co Ltd: stay extradition of Meng Wanzhou   ]

November 21, 2019 Lawyers for Huawei Technologies Co Ltd filed an application to a Canadian court to immediately stay the extradition proceedings of the company’s Chief Financial Officer Meng Wanzhou to the United States, Because Canada did not have sanctions against Iran at the time Canadian officials authorized commencing with the extradition process, double criminality cannot be met. The standard of double criminality means that the alleged conduct for which Meng was arrested in 2018 has to be illegal in both countries for her to be extradited

Patten and Kilimnik

Judge Amy Berman Jackson had sentenced W. Samuel Patten, a Washington lobbyist to three years probation.    Jackson has now released Patten early from probation because of his and prosecutors’ agreement, his “compliance” since he pleaded guilty and “in the interests of justice.”    Patten’s criminal case revealed how he worked for Ukrainian political interests that Manafort also served and how he funneled tickets for President Donald Trump’s inauguration to a Ukrainian oligarch and Manafort’s Russian business associate Konstantin Kilimnik.

EN+, Rusal, and EuroSibEnergo were sanctioned due to their connections with Oleg Deripaska rather than the “conduct of the companies themselves.” In an agreement with the Treasury, the three companies reportedly said they would “reduce Deripaska’s ownership stake, overhaul their boards of directors,” and be fully transparent with the department. Since the companies plan to reduce Deripaska’s influence, the department said it had determined that sanctions were no longer necessary.

Deutsche Bank asked two in-house financial crime investigators – Philippe Vollot and Hinrich Völcker – report on the Russian Laundromat.. Their nine-page presentation was shared last year with the audit committee of the bank’s supervisory board and is marked “strictly confidential”.

The pair identified numerous “high-risk entities”. They included 1,244 in the US, 329 in the UK and 950 in Germany. These entities were responsible for nearly 700,000 transactions, the report says, involving at least £62m in the UK, $47m in the US, and €55m in Germany.

As part of its investigation, Deutsche Bank sent 149 “suspicious activity reports” to the National Crime Agency in London. Similar disclosures of potential money-laundering transactions were made to authorities in the US and elsewhere – with 30 private and corporate Deutsche Bank clients reported. Some may have been “unknowingly used”, the report says.

The system dubbed the Troika Laundromat by the Organized Crime and Corruption Reporting Project involved at least 75 offshore companies and exported about $4.8 billion between 2006 and 2013, often through fictional deals, with help from a now-defunct Lithuanian bank, according to the OCCRP’s investigative journalists.

The oligarch, Ruben Vardanyan, is the former boss of Moscow investment bank Troika Dialog. The payments were from a company called Quantus Division Ltd, registered in the British Virgin Islands, which is revealed today to have been part of a network of offshore companies that sent billions of dollars out of Russia.

The network was managed by a Moscow investment bank, Troika Dialog, whose chief executive at the time was Mr Vardanyan, who was the 99th richest man in Russia two years ago,

Washington has frozen Oleg Deripaska’s US-based assets, including massive mansions in Manhattan and Washington, DC. But the feds are also negotiating with him to give up some of his European-based operations to keep them running free of sanctions, Treasury officials say.

Deripaska’s US assets include a mansion at 11 East 64th St.
FBI agents tried unsuccessfully to flip Deripaska in exchange for information on Russian organized crime — and Russia’s aid to President Trump’s 2016 campaign, the New York Times reported last month.
In an affidavit attached to a July 2017 application, an FBI agent said he had reviewed tax returns for a company controlled by Manafort and his wife that showed a $10 million loan from a Russian lender identified as Oleg Deripaska. When Manafort joined the Trump campaign, he owed Deripaska close to $20 million, according to legal complaints Deripaska’s lawyers filed in the Cayman Islands and New York

The Office of Foreign Assets Control (OFAC) of the US Department of the Treasury has identified Viktor F. Vekselberg and Renova Group, Moscow, as specially designated nationals pursuant to US sanctions rules, effective April 6, 2018.

Viktor F. Vekselberg indirectly holds an interest of 43.04 % in Oerlikon. Pursuant to the regulations of the OFAC of the US Department of the Treasury, Oerlikon is neither considered a sanctioned nor a blocked party because Mr. Vekselberg’s ownership interest in Oerlikon is less than 50 %. US persons and entities, as well as any other persons and entities, are therefore not restricted in their dealings with Oerlikon or in investing in Oerlikon. Press release(04/09/18).

Assets totaling between $1.5 billion and $2 billion have been frozen as a result of sanctions imposed on Russian oligarch Viktor Vekselberg and his Renova Group conglomerate, Renova, which is headquartered in Moscow and has a subsidiary in Zurich, intends to maintain its Swiss holdings, which include a stake in Oerlikon (OERL.S).

“We [Oleg Kouzmin and Daniel Salter] note that the fundamentals surrounding the Russian market remain mostly unchanged and that Russian equities still provide among the healthiest dividend returns globally. We would thus ignore the current jitters and buy into the current weakness, particularly with dividend season almost upon us.”

The economic impact of the new sanctions was also unclear and analysts said it was too early to revise forecasts.

[April 7]

SDN stands for “Specially Designated National.” In its statement announcing the sanctions, the U.S. Treasury Department said U.S. entities will be “generally prohibited from dealings with” the people and firms on the sanctions list.

In addition, it said, companies outside the United States “could face sanctions for knowingly facilitating significant transactions for or on behalf of” sanctioned entities.
Deripaska, with a net worth of $6.7 billion, is the main owner of the conglomerate EN+, which in turn is the co-owner of some of the world’s biggest metals producers, Rusal and Nornickel.

Hong Kong-listed Rusal is one of the world’s biggest aluminum producers. It says exports to the United States account for over 10 percent of its output.

Rusal owns assets in Italy, Ireland, Sweden, Nigeria, Guyana, Guinea. It owns a stake in Australian QAL, the world’s top alumina refinery.

Nornickel has assets in Finland, in Australia, where it holds a license to develop the Honeymoon Well Project, and in South Africa, where it has a 50 percent stake in the country’s only nickel concentrate producer, Norilsk Nickel Nkomati.

Swiss-headquartered Glencore is a shareholder in Rusal, and his said it plans to switch those shares to Deripaska’s newly-created holding company, EN+. According to a Rusal prospectus, its major customers include Glencore, Toyota, and Rio Tinto Alcan.

Other foreign firms with ties to Deripaska’s empire include Austrian construction company Strabag, in which the Russian’s firm Rasperia has a blocking stake, and Singapore’s Changi Airports International, which is a partner with a Deripaska-owned airports firm.

Hypersonic vehicles typically consist of a Supersonic Combustion Ramjet, or Scramjet propulsion system to enable such high speeds. A Scramjet engine is an engine that uses “air breathing” technology.[iii] This means that the engine collects oxygen from the atmosphere as it is traveling and mixes the oxygen with its hydrogen fuel, creating the combustion needed for hypersonic travel.[iv] This is different than a traditional ramjet, which is used on space shuttles and satellite launches.[v] The traditional ramjet engine carries liquid oxygen, and hydrogen together, adding a tremendous amount of weight to the vessel.[vi] Most of the added weight comes from the liquid oxygen (the oxidizer), which is nearly 70% of the fuel used in space launches.[vii]

[February 19 2020 1,000 low-yield U.S. nuclear bombs and cruise missiles ]

The U.S. already has about 1,000 low-yield nuclear bombs and cruise missiles, which could be dropped or fired from F-15, F-16, B-1, and B-2 aircraft. Advocates of the low-yield Trident missile W76-2 warhead argue that those planes might be shot down by Russian air defenses, whereas the Trident missiles—launched from undetectable submarines—would definitely get through Russian defenses.
50 warheads would be modified to the low-yield version, at a cost of $65 million, less than 0.1 percent of the entire defense budget.
.

[Febtuary 24 2020 Some W76 thermonuclear warheads to be modified to low-yield ]
W76

The deployment of the “low-yield” warhead W76-2 was reported last week by the Federation of American Scientists, citing anonymous sources and reporting that it was believed to have begun in the final weeks of 2019 with an Atlantic deployment of the USS Tennessee. The National Nuclear Security Administration (NNSA) has said the low-yield version, the W76-2, would be configured “for primary-only detonation.” This could mean a yield of less than 10 kilotons. It is the first major addition to the strategic nuclear arsenal in recent decades and is a departure from the Obama administration’s policy of lessening dependence on nuclear weapons
The W76 is a United States thermonuclear warhead. The first variant was manufactured from 1978 to 1987, and is still in service as of 2020. Trident II D-5 submarine-launched missiles, each carrying 4-5 W76 or W-88 warheads. Each W76 warhead has an explosive yield of 90 kilotons, or 90,000 tons of TNT. That’s enough to flatten a city or industrial target: by comparison, the atomic bomb dropped on Hiroshima was just 16 kilotons. Others D-5s carry the more powerful 455 kiloton W-88 warhead. In 2018 a new low-yield variant was announced which was expected to gain initial operating capability in 2019. The W-76 is carried inside a Mk-4 re-entry vehicle. The National Nuclear Security Administration announced in January 2019 that production of the first W76-2 had begun. The requirement calls for only a small number of warheads to be modified to the low-yield configuration.

The first test of a thermonuclear weapon, or hydrogen bomb, in the United States in November 1952 yielded an explosion on the order of 10,000 kilotons of TNT. Thermonuclear bombs start with the same fission reaction that powers atomic bombs — but the majority of the uranium or plutonium in atomic bombs actually goes unused. In a thermonuclear bomb, an additional step means that more of the bomb’s explosive power becomes available.

First, an igniting explosion compresses a sphere of plutonium-239, the material that will then undergo fission. Inside this pit of plutonium-239 is a chamber of hydrogen gas. The high temperatures and pressures created by the plutonium-239 fission cause the hydrogen atoms to fuse. This fusion process releases neutrons, which feed back into the plutonium-239, splitting more atoms and boosting the fission chain reaction

“John Rood, the Under Secretary of Defense for Policy. said the need for the new low-yield weapons came from intelligence reports of Russian emphasis on the use of nuclear weapons earlier in a conflict, “and the mistaken belief that they have the ability to use a low-yield nuclear weapon earlier in the conflict in a way to deter response.” He cited Russian President Vladimir Putin’s public statements advocating the early use of low-yield nuclear weapons “as a way of deterring an adversary.”

[July 17 2018 United States allows Japan to reprocess plutonium ]
hydrogenbomb1

On Tuesday (Jul 17), a decades-old deal with the United States which allows Japan to reprocess plutonium was renewed, but the pact can be terminated by either side with just six months’ notice.

Spent fuel from nuclear reactors is reprocessed to extract uranium and plutonium, which is then recycled into fuel called mixed oxide, or MOX, for use in both conventional nuclear reactors and fast-breeder reactors. Most reprocessing is currently done overseas, mainly in France, and Japan has struggled with technical problems at the new facility.
The country’s Atomic Energy Commission reportedly plans a self-imposed cap on the reserve, which now stands at 10 tonnes inside the country, with another 37 tonnes in Britain and France for reprocessing.
“Japan appears be caught up in the idea that in an emergency it can produce nuclear weapons with its reprocessing technology,” said Hideyuji Ban, co-director of the Citizens’ Nuclear Information Centre, an anti-nuclear NGO.

A judge in Milan ordered the release of one of the most influential bosses of Cosa Nostra, Francesco Bonura, 78, who was serving a 23-year sentence. The terms of Bonura’s release to house arrest allow his movement for health-related appointments.

Also ordered released from prison were Vincenzino Iannazzo, 65, and Rocco Santo Filippone, 72, both alleged ’Ndrangheta bosses. Judges feared that a Covid-19 infection could be lethal for Filippone since he suffers from serious cardio-vascular disease.

Rome, April 5 – Rome prosecutors requested the shelving of a probe into ex-premier Silvio Berlusconi on alleged sentence-rigging at the Council of State, Italy’s highest administrative court.
Last month the three-time former premier and media magnate was placed under investigation for alleged corruption in legal procedures.
The case concerns a ruling on March 3, 2016, by the Council of State, Italy’s top administrative court, that annulled the obligation for the ex-premier’s holding company to sell a stake held in financial services group Mediolanum.
Berlusconi’s lawyer Niccolo Ghedini told media outlets that he was sure the case would be dropped.

Silvio Berlusconi, an 81-year-old, arrived at his political homecoming party on the posh island of Ischia last month aboard a fancy yacht alongside his 30-year-old live-in girlfriend Francesca Pascale and his closest advisors. The Sicilian election held on Nov. 5 marked a strong political comeback for Silvio Berlusconi, handing government of the island to a center-right bloc backed by the four-times prime minister. Berlusconi brought his Forza Italia party to a somewhat astonishing victory in regional elections in Sicily when his candidates outperformed expectations on a platform for change which, for the longest-serving elected prime minister in modern Italian history, is a curious promise. But he also embraced an anti-immigration stance promising that Italy would no longer be the welcome mat for migrants. He promised his party would cut taxes and renegotiate some key trade deals, which, as a businessman only he has the smarts and the power to do. “It’s time to put Italy first again,”

More than 4.5 billion euros ($6.3 billion) in proceeds from counterfeiting, prostitution, labour exploitation and tax evasion had been sent to China in less than four years though a money-transfer service called Money2Money. Close to half the €4.5bn, transferred between 2007 and 2010, went through Bank of China branch in Milan. The Bank of China received €758,000 in commission for the transfers. The bank had an exclusive contract with Money2Money. Investigators said they got nowhere when they tried to appeal to Chinese authorities for help. Once the money left Italy, it vanished behind China’s great legal firewall. The case is now stalled in Italian courts, as prosecutors try to notify nearly 300 hard-to-find defendants, most of them Chinese. Prosecutors in Florence have filed a 170-page document to be reviewed by a judge, who will decide whether to file formal charges.

– Fininvest, the holding company controlled by the family of former Italian Prime Minister Silvio Berlusconi ,78 years (September 29, 1936), said February 12 it will sell a 7.8% stake in broadcaster Mediaset SpA.. The firm controls a 30% stake in bank Mediolanum , a 50% stake in publishing firm Mondadori and will continue to be the largest investor in Mediaset, with a 33.4% stake. It also controls soccer team A.C. Milan and other activities. But both Mediaset and Mondadori have been struggling with their finances.
The stake is worth 392 million euros ($447 million) at February 12’s closing price. Fininvest said the profits from the sale could also contribute to “investments aimed at portfolio diversification.” In 2005 the company had cut its stake in Mediaset to 34.3 percent from 51 percent.

Berlusconi will also regain his freedom of movement, which was restricted under the order, enabling him to resume a higher-profile role in national politics, despite still being banned from public office.
In a trial in Bari this week, businessman Gianpaolo Tarantini and six other people are charged with having promoted prostitution because, between 2008 and 2009, they organised for 26 different young women to attend parties in various Berlusconi residences.
To a certain extent, this trial involves a replay of the infamous Rubygate trial which in June 2013 found Mr Berlusconi guilty of “abuse of office” and having underage sex with Karim “Ruby” El Mahroug, then aged 17.

That judgment was later overturned by a January 2014 appeal court ruling which acquitted the media tycoon.
At issue then and now is the exact nature of Mr Berlusconi’s parties. Were they, as his defence always claimed, “elegant dinner parties” or were they, as various participants have reported, “bunga, bunga” nights of multiple sexual encounters?

The European Court of Human Rights has agreed to hear an appeal by former Italian Prime Minister Silvio Berlusconi against his conviction for tax fraud in August 2013, to examine Berlusconi’s argument that he had been denied a fair trial in the case. A date had been set for the appeal to begin.

[August 6]
Rome, August 6 – Former premier Silvio Berlusconi met August 6 with Premier Matteo Renzi to discuss reforms to Italy’s discredited electoral law, now being debated in parliament. The session in the premier’s office marked the third such meeting between Berlusconi, head of the center-right Forza Italia (FI) political party, and Renzi, who leads the center-left Democratic Party (PD).
The Prime Minister met with predecessor Silvio Berlusconi August 6 in a bid to rally parliamentary support for his reform bill, which was presented with nearly 8000 amendments on its first day in parliament.

[July 18 Ruby case overturned: Silvio Berlusconi sentence can be restored on appeal]

A Milan appeals court overturned a conviction of former Italian Prime Minister Silvio Berlusconi of paying for sex with an underage girl and then abusing his power in trying to cover it up. Italian prosecutors can appeal the July 18 decision to Italy’s highest appeals court. The final decision by the country’s highest appeals court isn’t likely to come before next year.
Mr. Berlusconi—who was then prime minister—phoned a Milan police station asking for information about a Moroccan woman, Karima El Mahroug, an underage nightclub dancer nicknamed Ruby Heart-Stealer, who had been detained for allegedly stealing cash. Ms. El Mahroug has always denied the allegations

The billionaire politician was sentenced to seven years in prison as a result of the guilty verdict last year. Mr. Berlusconi, who was also banned from public office and ousted from Italy’s Senate as a result of the tax fraud conviction, has always denied the charges in the sex case, which dates back to May 2010.

Prosecutors alleged that Mr. Berlusconi pressed the police to release the woman, thus constituting abuse of power. They also argue that Mr. Berlusconi sought to have her released to cover up the fact that he had paid her for sex when she was 17. Berlusconi claims that he never had sex with her and that, anyway, she told him she was twenty-four. He admits that he gave her thousands of euros at the end of her first evening at Arcore, and tens of thousands more later, but insists that these were innocent acts of generosity. He instructed the police to release her from custody, he says, because he thought that she was a niece of the former Egyptian President Hosni Mubarak, and he wanted to avoid straining diplomatic relations. (Mahroug, who was born in Morocco and grew up in Sicily, is not related to Mubarak.)

Marcello Dell’Utri, 72, landed at Rome’s Fiumicino airport on June 13 accompanied by Interpol officials and was handed over to the Italian police, airport authorities said.

An Italian court has sentenced Dell’Utri, who comes from Sicily, to seven years in jail for acting as a go-between for the mafia and the Milan business elite, including Berlusconi’s companies, from 1974 to 1992.
Lebanon extradited Dell’Utri to Italy on June 13 who fled to Beirut in April just before being found guilty of dealings with the Sicilian mafia.

Shares in Berlusconi’s Mediaset rose 3.5 percent on June 12 after reports that Telefonica (Madrid: TEF.MC – news) would make an offer to buy the Italian broadcaster’s stake in Spanish pay-TV group Digital Plus.
[May 13]
Supreme Court of Cassation in Rome has confirmed the sentence imposed on 72-year-old Marcello Dell’Utri by Palermo’s Court of Appeal in March last year.
The longtime ally of ex-premier Silvio Berlusconi is facing extradition to Italy after his arrest last month on an Interpol warrant in Beirut for allegedly fleeing a likely conviction from the supreme court for Mafia association.
“In the period of time we’re talking about a continuous crime,” said prosecutor Aurelio Galasso. Silvio Berlusconi – Italy’s former Prime Minister and one of the world’s most recognisable politicians – did business with the mafia for nearly two decades via his conduit and former senator Marcello Dell’Utri. Judges sentenced Dell’Utri to seven years for mafia association. Three-time premier Berlusconi, 77, has always denied rumours that mob links were behind the large and opaquely sourced investments used to kickstart his construction and media businesses in the 1970s and 1980s. But Supreme Court judges accepted prosecutor Aurelio Galasso’s claim that “for 18 years, from 1974 to 1992, Marcello Dell’Utri was the guarantor of the agreement between Berlusconi and Cosa Nostra”.

The one-year community service order may eventually be reduced by 45 days.

The state prosecutor supported the petition for community service, but asked the court to consider revoking it if Berlusconi insults judges while serving — something he has frequently done as he has fought numerous prosecutions over the years, mostly related to his business dealings.

The media mogul is on trial for political corruption in Naples and under investigation in Milan for witness tampering in trials relating to sex-fueled parties at his villa near Milan. His appeals trial for a conviction for having paid for sex with a minor and using his influence to cover it up is scheduled to open in June. He was sentenced to seven years in jail and given a lifetime political ban, but that has yet to be confirmed.

Italian Finance Minister Fabrizio Saccomanni says the sidelining of the longtime conservative leader leaves the government led by Prime Minister Enrico Letta “more cohesive and…more determined in the implementation of our program.”
.

Mr. Berlusconi—whose threats earlier this fall to bring down the Letta government made it exceedingly hard for the young coalition to govern—was stripped of his Senate seat because of a conviction for tax fraud.
.

Mr. Letta is under intense pressure to step up the pace of reforms aimed at freeing up Italy’s sclerotic economy.
.

The premier is hoping the government will survive until 2015, giving it time to cut taxes, ease labor laws and lower unemployment.
.

Mr. Saccomanni said Italy’s economy is slowly on the mend after what he described as a “deep depression.” The Italian economy has contracted for nine quarters in a row, and the government expects little more than anemic growth next year.
.

With a stronger majority in Parliament, the government should “operate with a more medium-term perspective than the one we have been obliged to have until now,” .

After months in which the Letta government teetered on the brink of collapse, European policy makers have publicly fretted over the ability of Rome to enact serious overhauls and keep its debt—currently more than 130% of gross domestic product—under control. Some regard chronic instability in Italy, the euro one’s third-largest economy, as the major threat to the currency bloc.

EU Economic and Monetary Affairs Commissioner Olli Rehn said that Italy has “no margins [to] maneuver.” He also expressed skepticism as to whether Mr. Letta’s government would manage, for instance, to achieve its ambitious privatization program.

[November 5]

Italian Senators will vote on November 27 on whether to expel center-right leader Silvio Berlusconi from parliament following his conviction for tax fraud, officials from the main parties said on Tuesday.

[October 23]
Italian ex-PM Silvio Berlusconi has been ordered to stand trial for the alleged bribery of a senator.
‘m
Berlusconi is accused of paying the left-wing senator 3m euros ($3.9m) to defect to his party in 2006 and help bring down the government.

The senator, Sergio De Gregorio, was sentenced to 20 months on October 23 at a plea bargain hearing in Naples.

[October 19]

The Court of Appeal of Milan ruled on October 19 that former Italian Prime Minister Silvio Berlusconi should be barred from holding public office for two years following a conviction for tax fraud.

However, since Berlusconi is a senator, the court’s decision will have no immediate effect and his expulsion from the Senate will depend on a separate vote in the upper house of parliament, expected to take place next month.

Bulgarian actress, producer and director Michelle Bonev has described her nights at his Arcore home. “This is how it works. At the end of the party, each girl has a request to make to him because she came to get something – a part in a film, a python handbag, a… to pay the rent, the electricity, the gas. He would stay in the room. We all went out and sat on the sofas. Then he would listen to what we wanted, one by one like the godfather”

The appellate court was ordered by Italy’s highest court to determine the length of the political ban accompanying his tax fraud conviction and four-year jail term after prosecutors conceded sentencing errors in the original five-year ban.

[October 3]

Prime minister Enrico Letta, the centre-left leader of the government won the Italian senate confidence vote with a sweeping majority. Only 70 of 305 MPs voted against; 235 MPs voted for. Berlusconi – the man who triggered the crisis and spent days clamouring for the government’s downfall – was one of them. Berlusconi been forced into a humiliating climbdown by a rebel faction of his own MPs, 32 senators voting with their leader, 24 absenting themselves, and 25 against him. He is scheduled for expulsion from the senate and the enforcement of his commuted one-year sentence, at the moment.

“In the end it’s all up to the PDL, I think there’s a deep debate taking place within the PDL.” Italian Prime Minister Enrico Letta
20 senators of Berlusconi’s People of Liberty, or PDL, are ready to form a breakaway group if the ex-premier doesn’t back down on his confrontation with Letta, perhaps. Letta needs 24 votes in the Senate to secure a new majority without Berlusconi. To do so, the 47-year-old premier must win over opposition lawmakers or convince members of Berlusconi’s People of Liberty party to abandon their leader.
[September 23]
Silvio Berlusconi was forced from office at the height of the euro zone debt crisis in November 2011. 54th Prime Minister of Italy Mario Monti ‘s efforts to deregulate services and labor laws were squashed by the parties that propped up his government before Italians gave him a resounding thumbs down at an election in February 2013 which produced no clear winner.

The resulting left-right coalition government led by Enrico Letta has bickered from the moment it took office and prospects for both growth and the debt have continued to worsen.

The economy shrinking 1.7 percent this year, down from a 1.3 percent contraction forecast in April, and it cut 2014 growth to 1.0 percent from 1.3 percent. Most analysts see growth of 0.7 percent at best next year.

Italy’s political situation has made no more progress than its economy, dimming prospects for the reforms needed to turn things around.

Italy’s medium term growth potential is now close to zero due to its failure to reduce costs and bureaucracy, tackle corruption or reform the justice system.
Since the days of the deepest crisis (in 2011) Italy has done nothing to improve its competitiveness, As a result its prospects for sustained debt reduction are non-existent.

Letta cuts a far more sober and reassuring figure than Berlusconi, but his ruling coalition is just as unruly and is deeply divided on economic policy.

Speculation has risen that there will be a new election in spring and on September 22 Economy Minister Fabrizio Saccomanni threatened to resign as the government squabbled over whether to suspend a hike in sales tax due to take effect in October.

[September 17]

Fininvest, The family holding company of former Italian prime minister Silvio Berlusconi was ordered on Tuesday to pay 494 million euros in damages stemming from the disputed purchase of publisher Mondadori.

Disgraced ex-premier Silvio Berlusconi made a 20-year pact with Mafia bosses to whom he paid millions of euros in exchange for protection and help with his business empire, according to a judicial report.

The tycoon’s deal with the mob was described by judges of the Palermo Appeals Court as part of their 476-page reasoning, released on September 5, behind the jail sentence for his Mafia association given to Berlusconi’s close friend Marcello Dell’Utri.

The judges say that Dell’Utri, a Palermo-born former senator in Berlusconi’s PDL (People of Freedom) Party, was the mogul’s go-between with the Cosa Nostra for 20 years, up until 1992, the year in which the Mafia assassinated two prosecutors in bomb attacks.

But while the crisis is leaving the Letta government’s prospects dim, Berlusconi’s Mediaset seems to have shrugged off the news. The shares have been on a tear so far this year, nearly tripling in value from their all-time low of €1.16 ($1.52) set in December by the end of July (the Supreme Court ruling was Aug. 1). They’ve been mostly flat since then, but they have still outperformed the Italian Stock Exchange’s blue chip index over that period, closing trading Friday at €3.36 ($4.40). Several investment banks have upgraded Mediaset’s ratings in recent weeks, judging that the tycoon’s political and legal woes are likely to have limited impact on the company’s day-to-day operations.

“Any definitive sentence, and the subsequent requirement to apply it, must be accepted,” Italian President Giorgio Napolitano said August 13 in an e-mailed statement. “That goes for the case at the center of attention today as with every other one.”
Napolitano noted that Silvio Berlusconi would not be expected to go to jail. Because of his age, the billionaire businessman is likely to serve the sentence under house arrest or doing community service.
Five Star Movement Founder Beppe Grillo, head of the biggest opposition party in parliament, said Napolitano was too lenient with Berlusconi and called on the president to resign.

[August 6]

Berlusconi already has a successor lined up — his daughter Marina. Marina is Berlusconi’s oldest daughter from his first marriage and has always been her father’s favorite. Despite having dropped out of university, Marina was installed as the chief executive of her father’s media company at the tender age of 30, making her — according to Forbes — the most influential woman in Italy.
On Facebook and fansites, she presents herself as a friend of Silvio’s fiancée Francesca Pascale. Marina, who is approaching her 47th birthday, doesn’t seem to mind the age gap. Her father’s new belle is only 27. In recent days, Marina has been a part of all high-level party meetings, a noticeable change from the past. Indeed, Berlusconi used to be fond of saying that he didn’t want his daughter to have to suffer as he has. Now, according to various Italian media outlets, Berlusconi has confided in a select few that his daughter should stand in the upcoming election. Berlusconi-owned “Il Giornale” has also predicted that Marina would perhaps throw her hat into the ring in her father’s place. The affection between father and daughter is clearly mutual. Despite marrying a ballet dancer and having two children of her own, Silvio remains his daughter’s main man. She refuses to tolerate even the slightest criticism of him. And there are other similarities as well: Marina and Silvio both enjoy a good dye job and the occasional surgical intervention. She is the daughter of Silvio Berlusconi with his first wife Carla Elvira Lucia Dall’Oglio, and is the elder sister of the businessman Pier Silvio Berlusconi. She is married to Maurizio Vanadia.

[August 4]

On August 1 Berlusconi was ordered to serve four years in prison, a sentence that has been commuted to one year under a 2006 amnesty and will consist, due to his age, of detention under house arrest or community service rather than jail.

The five judges of the court of cassation ordered another part of the previous sentence – a ban on public office – to be re-evaluated by a lower court. “If there is not a reform of the justice system we are ready for elections,” he told his followers. “This alliance is now unsustainable. The PD should draw up an exit strategy,” Pippo Civati, a centre-left MP, was quoted as saying. “Let’s pass the electoral law, then go straight back to the polls.” Whatever the government’s fate, Mr. Berlusconi isn’t about to start serving his sentence or lose his seat. He has until mid-October to decide whether to serve the year’s sentence at home or perform some socially useful service. And Senate procedures to strip him of his post will likely take months.

[July 10]
The Court of Cassation has decided to schedule an appeal in the media mogul’s tax fraud trial for July 30, months earlier than expected. The high court said it moved up the date to prevent the statute of limitations from expiring on one of the charges on Aug. 1. A high court decision could see former Premier Silvio Berlusconi banned for years from public office.
Although Berlusconi isn’t in the government himself, steady support from his center-right People of Freedom party is necessary to keep Premier Enrico Letta’s 10-week-old government alive, since Letta’s center-left Democratic Party doesn’t have enough support in Parliament to control both houses.
[June 25]
On June 19, Italy’s Constitutional Court rejected a procedural challenge related to Berlusconi’s October conviction for tax fraud. The tax-fraud conviction, upheld on appeal last month, carries a four-year prison sentence and five-year ban from public office. The final appeal for that case, involving Berlusconi’s related to the acquisition by his media company Mediaset SpA of television and film rights almost a decade ago., is underway. Mediaset, Italy’s dominant private television broadcaster, bought U.S. film and television rights at inflated prices, allowing the company to fraudulently lower its tax bill. Mediaset itself wasn’t charged. Separately, Mr. Berlusconi has appealed his conviction and the four-year jail term handed down by the lower court. Both were upheld last month by an appeals court, but a standard second appeal is pending.
Berlusconi has, according to his own estimate, been the subject of some 2,500 court hearings. But, incredibly enough, the former prime minister has yet to serve a sentence:
• 1990: Berlusconi is found guilty of perjury for providing false testimony regarding his membership in Propaganda Due, a subversive and illegal Masonic lodge. Amnesty granted in 1989 saves him from actual sentencing.
• 1994: Berlusconi faces corruption charges over subsidiaries of his company Fininvest paying bribes totaling $240,000 to tax inspectors. In 1998, he is sentenced to 33 months in prison, which he never serves because the statute of limitations expires during an appeal.
• 1995: Berlusconi is found guilty of falsifying documents during Fininvest’s acquisition of the Medusa film company. In 2001 he is acquitted, and thus never serves a mandated 16-month prison sentence.
• 1998: In his second conviction in a week, Berlusconi is sentenced to 28 months in jail for using an offshore company to bribe former Italian Prime Minister Bettino Craxi. An appeals court throws out the charges a year later because the statute of limitations has expired.
• 2002: The Italian Parliament passes a bill allowing defendants to appeal for a change of venue if there is “legitimate suspicion” that the judge involved in a case is biased. Berlusconi uses the legislation to his advantage by dragging charges out past the statute of limitations (he will go on to evade false accounting charges through other laws passed by his government).
• 2013: An appeals court upholds charges of tax fraud against Berlusconi after he is initially sentenced to four years in prison and banned from public office for five years in 2012. Berlusconi is now appealing the verdict to Italy’s highest court, which has yet to issue a final verdict.

A Milan court on June 24 convicted former Italian Premier Silvio Berlusconi of paying for sex with an underage prostitute during infamous “bunga bunga” parties at his villa and then using his influence to try to cover it up.

Berlusconi, 76, was sentenced to seven years in prison and barred from public office for life — a sentence that could mean the end of his two-decade political career. However, there are two more levels of appeal before the sentence would become final, a process that can take months.

U.S. District Judge Valerie Caproni of the Southern District of New York on May 5 2020 denied the request of Joseph Percoco, writing in a terse order that the “confusion at Otisville does not excuse defendant’s failure to file a motion for compassionate release with the BOP.”

Joseph Percoco asked a judge May 4 2020 to release him to home confinement due to the coronavirus outbreak. The attorney argued that Percoco is at grave risk if he contracts COVID-19 given his numerous health conditions, including hypertension, high blood pressure and high cholesterol.

Percoco, who is two years into a six-year sentence at FCI Otisville, was already authorized on April 11 for release by the Bureau of Prisons due to his health conditions. He was expected to walk out of Otisville on April 27 after a two-week quarantine, but the BOP has extended the quarantine and Percoco, 51, is about to begin his fourth week in isolation.

Joseph Percoco, Gov. Andrew Cuomo’s former top aide, has begun life as inmate No. 78132-054. Percoco, Cuomo’s former campaign manager and top aide, reported to federal prison in Orange County to begin his six-year sentence for taking more than $300,000 from companies with business before the state. He will serve his sentence at FCI Otisville, where he was recommended for the federal prison’s minimum-security satellite camp.

Seven people were eventually convicted or pleaded guilty in cases that hinged on testimony from Todd R. Howe. For that, he was rewarded with a sentence that included no prison time.

However, Prime Minister Manuel Valls signalled they could be modified.

French President François Hollande wrapped up a three-day tour of West Africa on July 19 with a visit to Chad,

Britain’s Daily Mail quotes Midi Libre ‘the highly respected newspaper’ as predicting that President Francis Hollande will marry Julie Gayet on August 12. ‘it is thought that Mr Hollande has felt increasingly uncomfortable attending official engagements without an official partner.’
During his speech on July 14 , François Hollande remained evasive on any developments in his private life, saying “When I have information to share, I will. But I have none” . A polite way of saying yes or no, leaving the door open to all speculations.

While Julie Gayet, a divorced mother of two, is barely known internationally, she is a well-known TV actress in France, having regularly appeared in a number of programmes, films and talk shows.

France warned Russia July 20 there would be “consequences” if Moscow did not put pressure on pro-Kremlin separatists in Ukraine to allow rescuers and investigators unfettered access to the crash site of flight MH17.
Francois Hollande, Angela Merkel and David Cameron agreed to call on their Russian counterpart Vladimir Putin to pressure the rebels into allowing rescuers and investigators “free and total access to the site of the MH17 flight disaster to accomplish their mission.” “If Russia does not immediately take the necessary measures, consequences will be drawn by the European Union at the Foreign Affairs Council which takes place on July 22,” the French presidency said in a statement after the leaders of France, Germany and Britain held a conference call.

The role of official girlfriend in the shadows “is no longer appropriate “

Are François Hollande and Julie Gayet are about to formalize their relationship?
For her, it would be nothing other than the logical outcome of a relationship that has developed peacefully for three years. A perspective that begins to germinate in the minds presidential, yet stubborn principle, any form of commitment. “He is for the status quo. Close friends say Julie has been putting on pressure since the Spring. The role of official girlfriend in the shadows “is no longer appropriate” to the mother. Julie Gayet grew up in old family, between an respectable mother and father who was a surgeon and internationally recognized digestive diseases specialist . “She inherited quite conventional manners,” says Yves Azéroual.
Since the revelation of the affair, the couple has continued to spend time together. After visiting the chateau of Berrac, with François Hollande and Julie Gayet’s parents secondary residence in July, the presentation to the respective families continues.Julie’s brother, Erwan Gayet, was surprised to cross the president in a Parisian Sunday lunch. The actress organizes dinners in his loft in the 11th arrondissement, where such friends as Julien Dray, a witness of the birth of her romance with the president. She was also able to take her companion to spend the evening with his friend, Benjamin Biolay. More importantly, she regularly goes to the Elysee, where it was not uncommon at the end of the day, to come across i Hollande ntimate, Stéphane Le Foll, François Rebsamen or Michel Sapin. In short, without showing off, the couple does not hide from his entourage. However, this is no longer appropriate to Julie Gayet, who finds that silence, clandestine love feeding the rumor mill. Most persistent being that of a “rapprochement” of François Hollande and Valerie Trierweiler. Despite the failure, the shadow of that “reporter” still hangs over the Elysee

[17 May 2011] Bernard-Henri Lévy defends Dominique Strauss-Kahn
Lévy, a French philosopher, says that his friend Strauss-Kahn ‘bears no resemblance to this monster being described’ [2013]‘I don’t like the donkey kick delivered to the “immensely rich” and “ambitious” woman who, for having schemed to become the wife of a president, is supposedly the truly guilty party, the one responsible for everything—an idiotic portrayal and, for anyone who knows or has observed the woman in question, an obscene accusation

In Beauty and the Beast, due to be released on February 27, Iacub says she had a relationship with Strauss-Kahn from January to August 2012, in the midst of the scandal over accusations he sexually assaulted a New York hotel maid the previous year.

She doesn’t name Strauss-Kahn in the book, but she told Le Nouvel Observateur magazine that it was about him, while admitting that she had mixed fiction with reality.

Strauss-Kahn’s lawyers said they will on February 26 seek the seizure of the books after suing Iacub and her publisher Stock for an attack on his private life.

If that is not allowed, they will seek for every copy of the book to carry an insert, lawyers Richard Malka and Jean Veil said, without giving details on what they want it to say.

Strauss-Kahn, who has called the book an “abomination”, is seeking 100,000 euros ($132,300) in damages and compensation from Iacub and Stock, and a similar amount from Le Nouvel Observateur.

Lawyers for Stock and Le Nouvel Observateur declined to comment on the suit, which will go before a Paris judge on February 26.

Carlton Affaire: DSK suspected of being the “instigator” of the network Judges in the Lille investigation say accordig to Le Figaro. ‘The judges felt that serious corroborating evidence make likely the effective and decisive participation of Dominique Strauss Kahn in acts of pimping,’ says Le Figaro.

[May 22 ’12]
French daily Liberation reported this month that two Belgian prostitutes questioned in the Lille probe described Strauss-Kahn as using violence during sex at the W Hotel in Washington and forcing a sexual act on her despite her protests.

Citing leaked transcripts of witness testimony to Belgian police, also involved in the probe, Liberation cited one of the prostitutes as saying that Strauss-Kahn “used force, he held down my hands, he pulled my hair, he hurt me.” The woman is quoted as testifying that another man held her hands down while Strauss-Kahn assaulted her.

Neither of the prostitutes has filed legal complaints, but French rules allow for an investigation even without a formal complaint.

According to a statement from the Lille prosecutor, the investigation centres on an incident “that could be described as gang rape”.

May 21, 2012 at 09:33 (Updated: May 21, 2012 at 09:42)

Prosecutors in Lille examines what took place between 15 and 18 December in Washington, during which parties participated Dominique Strauss-Kahn.

Prosecutors in Lille on Monday ordered a preliminary investigation of the facts ” could be described as gang rape “which allegedly took place in Washington between 15 and 18 December 2010, as part of the case known as the Carlton, he said in a statement.

The facts alleged were identified by the magistrates in charge of the case of aggravated pimping and allegedly committed at a party in the U.S. capital, attended by including Dominique Strauss-Kahn.

The prosecution stated that it had ordered an investigation, “according to the practice” , he confided to the direction of interregional judicial police in Lille.

He was seized on March 28 – two days after the indictment of Dominique Strauss-Kahn for aggravated procuring in an organized – by the judges, ” an order of referral for all practical purposes, for acts of gang rape. ”

These facts are related to testimony from two prostitutes who participated in a Belgian living in Washington in December 2010 along with Dominique Strauss-Kahn, Fabrice Paszkowski, David Pug and Commissioner Lagarde.

These testimonies were collected by the Belgian police last December, as part of an agreement with the French justice.

One of them – who has not complained – said to have been at a party, December 16, 2010, certain sexual acts in a non-consent.

Heard December 5, 2011 by the Belgian police – as part of an agreement with the French justice – she says that DSK would “use of force, that is to say, he held my hands. He pulled my hair, it hurt me. I weigh 50 kilos, it is heavier. ”

Always according to his account of the minutes, DSK then tries to sodomize. “I refused and told her no, I do not want. I tried to get loose but it was complicated because it was on me and it is very heavy […]. Admittedly, I did not yell, but I made it clear that I did not want to repeatedly aloud. ”

The allegations are said to have come to light from evidence given by a Belgian prostitute who told Belgian police that she was forced into certain acts of non-consensual sex while in Washington on 16 December 2010. She has not filed a complaint.

“I didn’t scream but I said clearly and loudly that I didn’t want to,” the woman is said to have testified.

But a second Belgian prostitute has called her account of events into question, in an interview with French media.

Police in Washington say they have checked their records for 16 December at the city’s W hotel, named by media as the hotel involved, and have found no reports detailing allegations of such activity.
[February 22]French police released former International Monetary Fund chief Dominique Strauss-Kahn on February 22 after nearly 30 hours in custody for questioning about a suspected hotel prostitution ring.
Strauss-Kahn, 62, is expected to be summoned again next month by judges who will decide if there is enough evidence to press charges in the case. Former IMF chief Dominique Strauss-Kahn, was taken into custody February 21 at Lille, to be heard on his alleged role in the case of pandering so-called Carlton.

It is common for judges anticipate the extension of police custody before the end of 24 premières hours, but it takes effect only after they passed. Ins and outs of the case of Carlton Lille “is the title of the article accompanying the photo of him that justice have been hearing this morning. Faithful to the words and commitments made during the press conference to launch the site information, the wife of former IMF chief wanted to be treated this case like any other information of this magnitude. Symbolic layout is none the less almost excessive in its form: as an exclamation point affixed to the bottom of an information, which should suffer in his mode of treatment, the smallest reproach. And this is the case.

Dominique Strauss-Kahn arrived voluntarily at a police station in the northern city of Lille just before his February 21) appointment for questioning about his role in the latest sex scandal to beset his ruined career.

Shortly after his arrival, prosecutors said he would instead be detained on suspicion of “complicity in pimping” and “misuse of company funds” and could thus face charges and see his detention stretch to 96 hours.

He insists he did not know that the women were prostitutes.

“I challenge you to distinguish a naked prostitute from any other naked woman,” his lawyer Henri Leclerc has told French television.
