Attorneys for multiple women who accuse Weinstein of sexual misconduct have publicly criticized the settlement, and several of them filed a formal objection to the deal. A confirmation hearing is currently set for January 14. More than 82 percent of those with sexual misconduct claims and 96 percent of general unsecured creditors cast ballots to accept the proposed settlement.
Nearly 40 women with sexual misconduct claims against Harvey Weinstein voted to accept the settlement deal that’s been presented as part of The Weinstein Company’s bankruptcy proceedings.

The proposed settlement includes a $17 million sexual misconduct claims fund that will be divided by a claims examiner using a point system. It also includes another $8.4 million for bankruptcy claims not related to sexual misconduct. U.S. Bankruptcy Judge Mary F. Walrath in November approved the protocols to send the deal to the accusers for a vote.

The overall settlement — meant to close out the Weinstein Company’s obligations as it works through bankruptcy proceedings — would reportedly “bring to an end” to nearly all sexual harassment and rape lawsuits against Weinstein.
The settlement would be paid by insurance companies representing the Weinstein Company .
More than $12 million of the current deal would cover legal costs for Weinstein and his brother, as well as other ex-members of the Weinstein Company’s board.

A so-called $44 million “global settlement” announced in May of the claims of dozens of women against Weinstein has seemingly hit the skids after various accusers cried foul over the hefty sums being paid out to lawyers and other reps for the now defunct board of the bankrupt The Weinstein Company.

A now July 15-set hearing in front of U.S. Bankruptcy Court Judge Mary Walrath in the District of Delaware may see the settlement matter revived in a discussion over the TWC estate appointing law firm Bernstein Litowitz Berger & Grossmann as special litigation counsel.

The money comes from insurance policies.

“We now have an economic agreement in principal that is supported by the plaintiffs, the AG’s office, the defendants and all of the insurers that, if approved, would provide significant compensation to victims, creditors and the estate, and allow the parties to avoid years of costly, time consuming and uncertain litigation on all sides,” Adam Harris, a lawyer for studio co-founder Bob Weinstein, told a bankruptcy court judge in Wilmington, Delaware, on May 23 2019.

Hollywood producer Harvey Weinstein has reportedly reached a $44 million settlement with a number of UK and US women over allegations of sexual harassment. Mr Weinstein will pay out £24million in compensation and an additional £11million in legal fees.

The money will be divided between 15 alleged victims and creditors who lost money when Mr Weinstein’s studio collapses following the allegations.

According to the Wall Street Journal the settlement was revealed by Adam Harris, a lawyer to Mr Weinstein’s brother.

Addressing a bankruptcy court in Delaware on Thursday he asserted: “We now have an economic agreement in principle that is supported by the plaintiffs, the New York attorney general’s office, the defendants and all of the insurers.”

Ashley Judd’s sexual harassment claim against Harvey Weinstein accusing him of sexual harassment in violation of a California law barring such conduct by a person in a “business, service or professional relationship” with another has been dismissed.
In a footnote to his ruling on January 9, District Judge Philip Gutierrez said he was not determining whether Judd was sexually harassed by Weinstein “in the colloquial sense of the term”.
The California Legislature revised the law last year, specifically adding film directors and producers to the categories of people who can be liable under the measure. Judd refiled the harassment claim under the revised law, which took effect Jan. 1.

Gutierrez ruled January 9 2019 that the changes were so significant that they fundamentally modified the California law — making it, in effect, a new law. And because the Legislature didn’t specify that the modified law should be applied retroactively, Judd can’t use it to pursue her sexual harassment claim, he ruled.

“In light of new information about misconduct by Harvey Weinstein that has emerged in the past few days” the board informed “Weinstein that his employment is terminated, effective immediately,” the company said in an email Sunday, October 8.

Harvey Weinstein won’t physically be a part of the awards race, not in 2017 and probably never again. But his fingerprints will be all over it. The push for “Wind River” will continue without Weinstein. And if the campaign seems more muted, the reason may less be Weinstein’s absence than the cash-flow problems that in recent years have made it impossible for TWC to carry out the kind of scorched-earth campaigns for which he was once known.

The Weinstein Company said it has retained an outside legal firm to conduct an independent investigation into the NYT allegations. TWC has retained John Kiernan of the firm of Debevoise & Plimpton “to undertake a thorough and independent investigation.” Kiernan will be assisted by his partners Matthew Fishbein, a former chief assistant U.S. attorney, and Helen Cantwell, a former federal prosecutor who also has worked for the New York County District Attorney’s sex crimes unit.

Michelle Williams is returning for “Venom 2”

While it’s not been officially confirmed yet, it seems fairly likely that the Venom sequel will be released on October 2nd 2020.

Sony has bookmarked that slot for an “untitled Sony/Marvel sequel,” and given that the first film came out in October to great success there’s no reason to suspect the studio would try and fix something that already worked.

[August 28 2019]

Given the blockbuster success of “Venom” with $856 million worldwide, it stands that Hardy and Williams will earn bigger paychecks for returning in the sequel. Robert Richardson, the three-time Academy Award-winning cinematographer who is coming off of Once Upon a Time in Hollywood, has signed on to shoot Venom 2.

Andy Serkis was tapped last week to helm the sequel to Sony’s 2018 hit, and the move now reunites him with the director of photography of his directorial debut, the 2017 drama Breathe. Richardson’s boarding also shows how fast the studio is moving on the project. Sony hopes to shoot the follow-up to “Venom” in the fall. “Venom 2” is likely to be released in October 2020.

Off a phenomenal China performance, Sony’s Venom continued to course this frame and has now crossed $800M worldwide. At $822.5M, it is the 2nd highest grossing superhero origin movie ever globally, behind Black Panther. Of $610.8M at the international box office, $242.9M is from the Middle Kingdom.

In China, “Venom” scored $87.2 million, a drop of just 14% from its opening weekend. Its 10-day cumulative score is $187 million. “Venom” carried the global box office this weekend, thanks to its massive $111 million debut in China.

That ranks as the second biggest opening ever for a superhero film in that territory, behind just “Avengers: Infinity War.” Its performance in the Middle Kingdom powered “Venom” to $673.5 million worldwide, including $467 million internationally. Though its impressive run in the U.S. is largely coming to a close, audience reaction overseas could propel the antihero film past $700 million globally.

Venom is still a record holder after Halloween gave the symbiote a bit of a fright this weekend. Halloween enjoyed an impressive $76.2M opening weekend but fell short of the October record Venom set a couple weeks ago with $80.3M. To date, Venom has earned $171.1M domestic and $461.8M worldwide.

With an estimated $80 million, Sony’s release of Venom into 4,250 locations not only topped the weekend box office, but it topped the previous October opening weekend record of $55.7 million set by Gravity in 2013 by over $20 million. It’s benefiting from being the shiny new superhero movie in a while. While Sony contends that the production cost was net $100M before P&A, it’s said to be around $116M with Georgia tax credits. Either way, it’s still cheap enough. If Venom had launched to $150M-plus globally –that’s even if the film had broken down stateside with a $55M-$60M opening–Venom would have still been safe. Internationally, Venom delivered $125.2 million from 58 markets for a record October global opening over $205 million. We’re told that a $450M global take ultimately gets Venom to break-even during its theatrical release. China’s Tencent is reportedly covering around a third of the production cost, however, a China release for Venom has yet to be announced. “If Venom is a big hit, maybe it’ll make it easier for a filmmaker like Kelly Reichardt to get her movie made. “

In order to be nominated, a film or actor doesn’t need to be considered “good” by everybody, but instead “the best” by a few: academy members are essentially voting for one movie; each member’s ballot is counted towards one film, their number one vote. If that film receives the fewest amount of number one votes, then it’s the second pick that counts, and so on down the ballot so that the ballot is attributed to exactly one movie or performance.

This year, Blue Valentine and Michelle Williams could benefit from this rule. The film itself hasn’t had a huge box-office take, but those who have seen it are rapturous in their praise, particularly for the gutting performances by Gosling and Williams.

Ryan Gosling and Michelle Williams give two of the most explosive and emotionally naked performances you will see anywhere.

As we enter film awards season this year, a new trick has entered the fray. Cunnilingus: it’s this year’s disabled/abused/gay/mental illness/foreign accent!
While it is always satisfying to see an onscreen acknowledgement that a man might do a little bit more during sex than pump and grunt, I approach this latest cinematic development freighted with qualms, and not just because of the intimation that getting in between a woman’s legs is … edgy and niche… First, it means watching actresses practise, in close-up, at length, their sex faces, which is almost as painful as listening to Nicole Kidman’s English accent in The Hours…
Which brings us back to the point that it is apparently easier, or at least more acceptable, to show cunnilingus between two women than a man and a woman: neither Black Swan nor The Kids . . . were threatened with an NC-17 rating to my knowledge. But then, of course, women don’t mind doing it to each other. They don’t find it so, you know, gross. And it’s probably easier for them, right? What, with their inside knowledge of the area, so to speak. Hadley Freeman

Twenty years after introducing the designation, first given to “Henry and June” as a solution to the stigma of the X, the NC-17 is still regarded as a box-office buzzkill. There’s a longtime perception that exhibs won’t screen an NC-17 film and that advertisers deny such pics ad space. Ang Lee’s “Lust, Caution” in 2007 was one of the few recent cases where a distributor accepted that rating rather than making cuts. The National Assn. of Theater Owners polled 100 exhibitors to see how many would refuse to screen the movie, and only five said they would not. The Focus Features title went on gross to just under $5 million domestically. Ratings board chair Joan Graves admits moviegoers have a skewed perception of the NC-17 rating. “I do regret that it’s treated as the pariah of the ratings system,” she says. “All we need is one popular NC-17 rating to take that scent away.”

The Weinstein Company is moving up the release of Michelle Williams and Ryan Gosling-starring Blue Valentine two days to Wednesday, December 29, reports deadline, to get a two-day head start on the New Year’s holiday weekend.
