Douglas Wigdor is no longer representing Tara Reade, just two weeks after he first began working with her.   Associated Press said she appears to have exaggerated her educational achievements, was mired in endless financial difficulties and faced frequent lawsuits with individuals who said she defrauded them or failed to pay bills.
Wigdor’s firm originally said Reade had struggled to find a lawyer to represent her because many attorneys in his space “tend to be Democrats or liberals,” and Reade has accused the presumptive Democratic presidential nominee of sexual assault.

Dominique Huett will remove herself from the Harvey Weinstein settlement in order to pursue her own claim. Huett has retained a new attorney, Douglas Wigdor, who represents two others who have opted out. Wigdor believes the $500,000 Huett was offered was “not fair”. This is a suit for the alleged assault under New York’s recently enacted Child Victims Act, which extends the amount of time a victim has to bring a claim (until their 55th birthday in some cases). She agreed but alleges his driver brought them to Weinstein’s apartment instead. There, she claims “he terrified and sexually abused her.”Her attorneys, Douglas Wigdor and Kevin Mintzer: “While others may have decided to settle, albeit under some of the most offensive and one-sided terms, we hope that the filing of this complaint encourages other victims and the New York Attorney General to join us as we continue our efforts at holding Harvey Weinstein and his enablers accountable.”

They’re bringing a battery suit for the alleged 2002 assault under New York’s recently enacted Child Victims Act, which extends the amount of time a victim has to bring a claim (until their 55th birthday in some cases).

Harvey Weinstein’s bail was increased from $1 million to $5 million on December 11 2019 over allegations he violated bail conditions by mishandling his electronic ankle monitor.   Prosecutor Joan Illuzzi told the court that the person monitoring Weinstein does not believe the problems due to were technical glitches. While the monitoring now appears to be working, Illuzzi said she thought that was because of the threat of new bail.   Weinstein will be undergoing back surgery on December 12 2019. “If you have any further medical issues, the court will not be terribly understanding,” Judge James Burke said.

New York judge James Burke on November 26 2019 issued an ominbus ruling that declined Weinstein’s request to unseal the names of two complaining witnesses, one of which is reportedly Sciorra, and made several other rulings on witness testimony.

Barbara Ziv, an expert on sexual assault and rape trauma syndrome, will be allowed to testify over Weinstein’s objections. Weinstein’s experts on human memory, Deborah Davis and Elizabeth Loftus, will also be allowed to testify — but they won’t be allowed to provide testimony on issues of memory specifically tied to sexual interactions and “the phenomenon known as ‘voluntary unwanted sex.'”

Weinstein asked the court to dismiss two counts of Predatory Sexual Assault, arguing that it requires that the defendant had committed an “underlying crime” and had engaged in an “aggravating crime.” Here the underlying crime is alleged to be a July 2016 rape and the aggravating crime is an alleged rape during the winter of 1993-1994, and Weinstein argued the alleged aggravating crime happened before the Predatory Sexual Assault statute was enacted in 2006 and therefore the two counts that relied upon it should be dismissed. Alternatively, he argued that they should be dismissed because the alleged victim of the mid-’90s rape can’t further narrow down when it happened. The producer also asked the court to dismiss the superseding indictment as a whole on procedural grounds.

A new and sealed grand jury indictment was issued August 22 2019 against the fallen movie mogul and accused sexual predator.

Manhattan Assistant District Attorney Joan Illuzzi-Orbon said in a letter to the judge and defense attorneys on August 13 2019 that prosecutors would re-present their case to a new grand jury starting on August 16 2019 in order to include the testimony of a woman who claims Weinstein raped her at her apartment in New York in the winter of 1993-1994.

Such changes in an indictment give the defense up to six weeks to respond, which would postpone the already pushed back trial start. Harvey Weinstein’s lawyer Arthur Aidala has moved for a change of venue on August 16 2019. Cyrus Vance Jr.’s office declined comment August 20 2019 on the new filing. A response is expected to be formally filed in the next few days.

Manhattan District Attorney Cyrus Vance Jr.’s office planned to present another alleged victim of Weinstein’s to a grand jury to support predatory sexual assault charges against him, according to court filings.
The accuser is Annabella Sciorra, the actress known for her role in “The Sopranos” who says Weinstein violently raped her in 1993, Prosecutors directed Weinstein to appear before the grand jury August 15 2019 if he wanted to testify, court records show. The grand jury must vote on a new indictment before its term ends Aug. 26, just two weeks before the scheduled start of Weinstein’s trial on Sept. 9, the filings indicate.

Justice James Burke said in a one-line decision on August 7 2019: “The request for a change in bail conditions is denied.” He refused to allow Harvey Weinstein to travel to Europe to consult on a stage production of Cinema Paradiso, a 1988 film that he was involved with that won the Academy Award for Best Foreign Language Film at the 62nd Academy Awards.

Weinstein is set to go to trial on September 9 in New York for rape and could spend the rest of his life in prison if found guilty. Thus, the pleas from his attorneys to allow him to travel to Italy and Spain was quickly turned down. Weinstein wanted to travel Aug. 12 through Aug. 22 for the project.

Justice James Burke refused to allow testimony from Annabella Sciorra, who accused Weinstein of sexually assaulting her in 1993, but also refused Weinstein’s legal team’s bid to toss out some counts, Burke rejected prosecutors’ argument that language in the predatory sexual assault statute gave them “leeway” in terms of introducing “additional persons” at trial, and granted the defense motion to exclude Sciorra from the case.

Director Ara Bradley Paiaya: his debut ‘Hollywood’ feature film is ‘Skin Traffik’ . Rugby League player Keith Mason is set to appear on screens in just a few months’ time alongside Mickey Rourke and Daryl Hannah in Skin Traffik, directed by Ara Paiaya (The Suppressor, Maximum Impact). The film is a dark tale set in the world of human trafficking, with a jaded hit man regaining his humanity amidst a brutal underworld, in which daily survival is not so much a skill, but an instinct. The cast is headed by British action star, Gary Daniels and sees Michael Madsen, Mickey Rourke and Darryl Hannah all popping up to phone in performances. Skin Traffik is due out in the UK at the end of Summer 2014, maybe.

Harvey Weinstein’s defense attorneys are following a classic strategy, seizing on what they say are prosecutorial missteps and misguided judicial rulings to build a case for a potential appeal after the Hollywood producer’s rape trial.

Jurors in the trial against Harvey Weinstein were deadlocked. The jury is hung on the first and third charges — of predatory sexual assault — and unanimous on the other three charges. To convict Weinstein of predatory sexual assault, the jury must be convinced that he committed a first-degree sexual offense against Annabella Sciorra and either Miriam Haley or Jessica Mann, or both.
There are a variety of ways in which the jury is limited as to possible outcomes. They will present their decision under the form of a verdict sheet, which comes with instructions. Jurors are supposed to begin by deciding on the predatory sexual assault counts – the very ones they seemed to struggle with this Friday – before tackling or skipping the other three. The verdict sheet forbids certain combinations, too – finding Weinstein not guilty on a specific count would mean issuing an identical verdict on another count, etc.

The prosecution issued their disapproval. The Weinstein legal team said they would accept a partial verdict.

“It is not uncommon for a jury to believe they will never reach a unanimous verdict but on further deliberation, they are often able to reach a unanimous verdict,” Burke told the courtroom.

Judge approved a new Weinstein legal team. After approving Baez’s request to withdraw from the case, Burke called him to the bench for a one-on-one chat that lasted about five minutes with no court reporter to transcribe the conversation.

While it’s not been officially confirmed yet, it seems fairly likely that the Venom sequel will be released on October 2nd 2020.

Sony has bookmarked that slot for an “untitled Sony/Marvel sequel,” and given that the first film came out in October to great success there’s no reason to suspect the studio would try and fix something that already worked.

Given the blockbuster success of “Venom” with $856 million worldwide, it stands that Hardy and Williams will earn bigger paychecks for returning in the sequel. Robert Richardson, the three-time Academy Award-winning cinematographer who is coming off of Once Upon a Time in Hollywood, has signed on to shoot Venom 2.

Andy Serkis was tapped last week to helm the sequel to Sony’s 2018 hit, and the move now reunites him with the director of photography of his directorial debut, the 2017 drama Breathe. Richardson’s boarding also shows how fast the studio is moving on the project. Sony hopes to shoot the follow-up to “Venom” in the fall. “Venom 2” is likely to be released in October 2020.

In China, “Venom” scored $87.2 million, a drop of just 14% from its opening weekend. Its 10-day cumulative score is $187 million. “Venom” carried the global box office this weekend, thanks to its massive $111 million debut in China.

That ranks as the second biggest opening ever for a superhero film in that territory, behind just “Avengers: Infinity War.” Its performance in the Middle Kingdom powered “Venom” to $673.5 million worldwide, including $467 million internationally. Though its impressive run in the U.S. is largely coming to a close, audience reaction overseas could propel the antihero film past $700 million globally.

With an estimated $80 million, Sony’s release of Venom into 4,250 locations not only topped the weekend box office, but it topped the previous October opening weekend record of $55.7 million set by Gravity in 2013 by over $20 million. It’s benefiting from being the shiny new superhero movie in a while. While Sony contends that the production cost was net $100M before P&A, it’s said to be around $116M with Georgia tax credits. Either way, it’s still cheap enough. If Venom had launched to $150M-plus globally –that’s even if the film had broken down stateside with a $55M-$60M opening–Venom would have still been safe. Internationally, Venom delivered $125.2 million from 58 markets for a record October global opening over $205 million. We’re told that a $450M global take ultimately gets Venom to break-even during its theatrical release. China’s Tencent is reportedly covering around a third of the production cost, however, a China release for Venom has yet to be announced. “If Venom is a big hit, maybe it’ll make it easier for a filmmaker like Kelly Reichardt to get her movie made. “

In order to be nominated, a film or actor doesn’t need to be considered “good” by everybody, but instead “the best” by a few: academy members are essentially voting for one movie; each member’s ballot is counted towards one film, their number one vote. If that film receives the fewest amount of number one votes, then it’s the second pick that counts, and so on down the ballot so that the ballot is attributed to exactly one movie or performance.

This year, Blue Valentine and Michelle Williams could benefit from this rule. The film itself hasn’t had a huge box-office take, but those who have seen it are rapturous in their praise, particularly for the gutting performances by Gosling and Williams.

Woody Allen and Amazon have come to an agreement to finish a lawsuit that challenged Amazon’s early termination of the filmmaker’s deal. The dismissal occurs after the European opening of Allen’s A Rainy Day in New York — one of the films that was to have been covered by the Amazon agreement. A Rainy Day in New York is earning notably less overseas than many of Allen’s other films, although his last outing, Wonder Wheel, topped out at $13.7 million internationally.

During cross-examining at the trial of former Italian prime minister Silvio Berlusconi , it was revealed that Ambra Battilana,sued a 70-year old businessman for sexual assault. The man admitted to a relationship but considered it consensual, counter-claiming that he instead paid her handsomely with jewels, a car and when she was a contestant in the Miss Italy pageant. The unnamed man, referred to as Mr. G. in the Italian press, told Il Giornale, owned by Berlusconi’s family, that he suspected Battilana had become a “jolly” for the prosecutor, effectively accusing her of turning states evidence to avoid charges. She denied those claims.

The Weinstein Co. has struck a deal to restructure its debt. The settlement calls for the New York studio, run by Bob and Harvey Weinstein, to turn over about 200 titles from its catalog to Goldman Sachs and insurance company Assured Guarantee, which were owed $450 million as part of a $1.2-billion financing package the investment bank arranged for Weinstein Co. when it launched in 2005, The movies handed over by Weinstein Co., which include the 2007 remake of “Halloween,” and the 2008 Woody Allen comedy “Vicky Christina Barcelona,” are estimated to be worth at least $233 million in future revenue.Under the settlement, insurance company Ambac, which insured $500 million of Weinstein Co.’s debt, will pay $115 million to Goldman Sachs and Assured. The deal wipes out the studio’s debt and gives it the opportunity to continue producing and releasing movies.

Harvey Weinstein is charged with rape in the first and third degrees for a forced sexual act in March 2013 against a woman in New York. He was later accused of a criminal sexual act in the first degree for a forcible sexual act against another woman in 2006, as well as two counts of predatory sexual assault. Jury selection begins Sept. 9 and the trial will likely last four to six weeks. The identities of the women in the upcoming trial have not been released.

Harvard Law School Professor Emeritus Alan M. Dershowitz has joined Harvey Weinstein’s legal defense team to consult on constitutional issues, according to a Feb. 15 court filing. The suit Dershowitz is involved in is a class action lawsuit against Weinstein’s former production companies the Weinstein Company and Miramax; the Walt Disney Company; and Weinstein himself, among others. The lawsuit alleges that Weinstein violated federal sex trafficking laws.
Justice James Burke and prosecutors agreed to the new Manhattan Supreme Court trial date of June 3. Baez and Sullivan are slated to start a 10-week trial Feb. 19 in Brooklyn federal court.

A growing chorus of Harvard students are demanding that Ronald Sullivan, Jr.,  — the university’s criminal justice institute director and faculty dean at Harvard’s Winthrop House residence — resign from Harvey Weinstein’s New York defense team ASAP. Harvey Weinstein by his attorney Benjamin Brafman has moved a Manhattan judge to dismiss the five remaining criminal charges against him, providing additional details to support his claim that police misconduct tainted grand jury proceedings and that prosecutors failed to turn over evidence that he had a consensual relationship with one of his alleged victims. “Simply put, because of the unprecedented and outrageous misconduct already documented in this case, this court should properly give serious consideration to dismissal of this deeply flawed indictment, either for the legal reasons we have provided or so that the integrity of the criminal justice system can be restored,” Brafman wrote in the 51-page document.

A judge denied a request from prosecutors July 9 to place Harvey Weinstein under house arrest in light of new charges against the movie producer that carry a penalty of life in prison if he is convicted.

Brought into the courtroom in handcuffs, Weinstein, 66, was released on bail after pleading not guilty in state Supreme Court in Manhattan on charges that he sexually assaulted a woman in 2006.

Three women have now accused him of forcing them to have sex against their will over the last 14 years, and the new indictment includes two counts of predatory sexual assault, opening him up to a life sentence.
